Wallingford (WTNH/AP) -- A Durham man has filed a second lawsuit against a Wallingford rifle range, claiming the Blue Trail Range poses a lead contamination threat.
Pasquale DiNatale's latest lawsuit claims that lead discharged from Blue Trail into the adjacent Ulbrich Reservoir harms local wildlife and threatens human health.
Tests done on the reservoir this summer showed lead levels well below the acceptable level.
DiNatale also names the town of Wallingford for alleged negligence in enforcing safety standards.
In June, DiNatale filed a lawsuit in New Haven Superior Court seeking to shut down Blue Trail Range until it could be deemed safe by a judge. That suit was filed over concerns about stray bullets.
Some Durham residents have reported finding bullets embedded in their homes and in their yards.

New lawsuit targets Blue Trail, Wallingford

WALLINGFORD - In his second lawsuit against Blue Trail Range, Pasquale "Pat" DiNatale alleges the North Branford Road rifle range poses a lead contamination threat and names the town of Wallingford for alleged negligence in enforcing safety standards.
In addition to seeking more than $15,000 in compensation from the defendants, the suit calls for a lead cleanup and a court order forcing the town to purchase Blue Trail for $90,000. A 1961 contract gives Blue Trail the option to sell its property to Wallingford for $90,000 in the event that it is deemed illegal for health reasons.
DiNatale, a Durham resident, alleges in the suit that lead discharge from Blue Trail harms local wildlife and threatens human health. Blue Trail is adjacent to the Ulbrich Reservoir, a major source of Wallingford's drinking water.
Water flowing from the Ulbrich has routinely tested clean, though testing during a rainfall found lead particles in a stream flowing from the Blue Trail property into the reservoir.
"The main goal is for someone to accept responsibility for the contamination of that water," DiNatale said.
Town Attorney Janis Small said the lawsuit will not stop the town from continuing to assess the situation independently.
"We're going to continue to proceed along those lines and we're looking to see what we should be doing and what we can do," she said.
DiNatale has railed against the gun range since bullets struck his home in April. State police have not concluded where the bullets came from. The lawsuit was filed with the town Aug. 29.

This guy is on the warpath and grasping at any straws he can to shut down the range. With the height of the earth berms on the 100yrd. range there is no possibility of a bullet escaping the confines of the range. Not a single new "bullet strike" has been reported since the range re-opened...so now he has to come up with some new unfounded thing to attack the range about.
The fact remains lead tests were conducted by the DEP and all proved to be well below acceptable levels.
Also, DiNatale has big interests in seeing the range closed. He wishes to purchase the land and sell it to developers like Wal-mart, making a huge pay-day in the process. :(
All of this just stinks so bad that the flies are circling. :mad:
